Description of Property to be Seized: Trace Evidence in the form of aural content of voicemails, whether new and un-played or previously accessed, that may still be in the cingular wireless account. These voicemails are in an electronic format designed to record sounds such as voices. Other trace electronic content saved inside this cell phone, including saved call records, missed calls, settings, contact lists, saved images and video, and saved text messages. Aural content of saved answering machine messages stored within an answering machine collected as evidence from Birchleaf dr. from the upstairs master bedroom. Similiar electronic and aural voicemail content from a cell phone found in a purse in the kitchen, same house, phone number and provider unknown. Video and audio content of two camcorder devices and associated tapes and DVDs for these devices recovered from the same house. Other electronic content of some CD's collected from the same house.

Probable Cause: Michelle Marie Fisher Young was found murdered on Nov 3, 2006 in her home on Birchleaf in Wake County. Jason Lynn Young is the victim's husband. The witness who found the victim was a sibling. The sibling reported getting a voicemail from Jason Young about how she was needed to go to the house to retrieve some documents. When she went to the house she located the victim.

Jason Young has been uncooperative.

Inv McCormack WCSO found out from Cingular Wireless, the provider of the #, about the existence of saved voicemails attached to the account, Inv McCormack reported making analysis of Jason Lynn Young's call activity on the account; Young made regular, frequent checks of his voicemail. The account is a local number attached to a Raleigh phone switch. Upon receipt of a copy of a search warrant issued pursuant to probable cause, Cingular would release electronic audio files of the voicemails from their service system to WCSO.

The items seized: A quantity of voicemails/electronic contents of the cell phone, electronics and other audio media search has commenced. Exact content is still under collection, analysis, documentation and under further investigation.
